Each participant under 18 must be accompanied by a responsible participant 18 or over. Each participant under 12 must be in same kayak as an adult. No one under 8 allowed.
Kayaking at Upper Newport Bay is a moderately strenuous activity involving exposure to sun, wind, salt water and other hazards, including the risk of capsizing. Dress appropriately and use sun protection.
NBC kayak tours depart from the Newport Aquatic Center (NAC) located at 1 White Cliffs Dr. Newport Beach, CA 92660. Plan to arrive at 9:45 AM. NBC WATER TOUR WAIVER
2. I am aware that myself and my belongings may get wet, that exposure of cell phones, digital cameras and other items to the salty water in the Bay may cause irreparable damage, and that keys that are not secured may be lost in the event of a capsize. I assume all responsibility for my belongings.
3. I will wear and keep snugly fastened at all times the life preserver provided to me.
4. I will comply with the instructions provided by the tour leader(s) and facility staff, and will return promptly to the point of launch at the end of the tour.
5. I agree to pay to the Newport Dunes or Newport Aquatic Center any charges incurred for returning late or for equipment loss or damage because of misuse.
6. I waive all claims and agree that I will not sue the Newport Bay Conservancy or the Newport Aquatic Center, or any of their owners, officers, partners, employees, agents or members, for any injury or damage that occurs before, during or after the tour.
When you check in for the tour you will be asked to sign the following waiver.
This document contains a release and waiver of important legal rights. Please read carefully. By signing for yourself or as guardian on behalf of anyone under 18, you agree:
1. I am aware that certain risks exist in kayaking and canoeing. Among other things, these risks include adverse weather, exposure to the elements, over-exertion, capsizing, collisions with other vessels or objects, and drowning. These risks may be higher when pre-existing medical conditions are present and/or such conditions may be worsened by paddling. Such risks, as well as unforeseen events/conditions, could lead to physical injury or death. I participate in this water tour with the knowledge of the risks involved, and agree to accept any and all risk of injury or death.2. Cancellation Policy
The number of participants on each kayak tour is limited in order to make the experience as enjoyable as possible. Advance reservation and prepayment by credit card is required. Cancellations made less than 24 hours before the start time of the tour and no-shows will be charged the full $20 per person tour fee. Cancellations made more than 24 hours in advance will receive full credit towards a future tour. Sorry, no refunds except when the tour is cancelled by NBC because of bad weather.
